Harris County, TX — A driver was arrested on a felony DWI charge after two Harris County Precinct 5 sergeants encountered the vehicle while leaving a local restaurant on Sept. 3.

According to Constable Terry Allbritton’s Office, the sergeants were leaving the restaurant when they saw a vehicle park next to an occupied marked patrol vehicle. Authorities said the passenger was observed consuming an alcoholic beverage inside the vehicle, while the driver displayed multiple signs of intoxication.

Both occupants were detained while deputies investigated. After Standardized Field Sobriety Tests were administered, the driver was taken into custody for Driving While Intoxicated.

Investigators determined the driver had two previous DWI offenses, making the latest charge Driving While Intoxicated — Third Offense, a felony. The driver was transported to the Harris County Jail.

The passenger was also taken into custody for Public Intoxication and transported to the Houston Recovery Center.

Authorities did not identify either person in the information released.

The charges are allegations. Those accused are presumed innocent unless proven guilty in a court of law.
